A. It is agreed and understood by and
between the parties that this dog has not been purchased for resale or for use in any
wholesale breeding operation. It is further agreed and understood that this dog will not
be resold to any pet shop, dog farm, wholesaler, or agent of the same. Buyer agrees to
prevent any offspring of this dog from being sold or used by such parties.
B. In the event that the Buyer changes
address and/or telephone number, buyer agrees to immediately provide Seller with the new
address and phone number no later than fourteen (14) days after either change.
C. Buyer agrees to immediately notify
Seller if the dog is lost, stolen, or dies.
D. The dog sold pursuant to this contract
is warranted to be in good health to the best of the Seller’s knowledge at the time
of sale. Seller will warranty the health of the dog purchased from the time of the sale
and for seventy-two (72) hours thereafter, during which time, at the Buyer’s expense,
the dog must be examined by a licensed Veterinarian. Should the dog be determined to have
a serious health problem, and the cause of such illness can be directly related to the
Seller, the dog may be returned for a full refund of the purchase price. In order to claim
a refund, the Buyer must provide sufficient documentation from the examining Veterinarian
concerning the dog’s illness or genetic defect. In any event, the dog shall be
returned to the Seller within seventy-two (72) hours of the date of purchase.
E. Buyer fully understands and agrees that
the dog subject to this contract MAY NOT AT ANY TIME be sold, traded, given or ownership
transferred in any manner without the express written consent of the Seller. Buyer further
agrees and understands that any time during the life of the dog, should Buyer need or
desire to part with or sell the dog or is unable to properly care for the dog or for any
other reason(s), Buyer will immediately notify the Seller. At such time, Seller will take
back said dog and if the dog is under four (4) years of age, pay Buyer a sum equal to
one-half the purchase price. Buyer agrees and understands that the refund amount will be
LESS the amount of a thorough examination by a licensed Veterinarian, and the cost of all
treatments, medications and the estimated cost of possible future medical treatments and
medications. Buyer further agrees that at the time Seller takes possession of said dog,
Buyer shall immediately sign ownership back to Seller. At that time, Buyer also agrees to
give all and any records concerning the health and care of the dog to Seller.
F. Buyer understands and agrees that the
dog subject to this contract will be used solely for the purpose of a family
companion, and as a show dog. Buyer further understands and agrees that the dog will be
used for no other purpose.
G. Buyer agrees to show the dog at the
Buyer’s expense, and will put forth a best effort to obtain an AKC conformation
championship. If Buyer is unable to finish the dog by thirty (30) months of age, Seller
shall have the right, but not the obligation, to enter and show the dog in AKC events in
an effort to obtain the conformation championship. Buyer will be responsible for all entry
fees.
H. Buyer understands and agrees that the
dog shall live inside of the family home at all times. Buyer agrees that the dog WILL NOT
be a kennel dog and will never live outside or be chained or tied outdoors.
I. Buyer agrees to take proper safeguards
for the care and safety of the dog sold herein, including but not limited to necessary
food, veterinary care, and general care to maintain good and proper mental and physical
health. Buyer further agrees to provide a safe and securely fenced area large enough for
the dog to exercise, play and eliminate in.
J. Buyer agrees to provide formal
socializing and obedience training for the dog to the extent that the dog will not be a
threat or menace to other animals, people, or property.
K. Buyer agrees that if the dog purchased
is a male, the Seller has the option of two (2) stud services to the Seller at no charge,
and to the Seller’s choice of female. When each breeding results in two (2) or more
live puppies, no further stud services are owed. The Buyer must make the male available to
the Seller on the days best for breeding the female or cooperate in collecting and
shipping fresh chilled semen. If Seller chooses to use this breeding option, all
veterinary costs and/or shipping costs will be at Seller’s expense.
L. Buyer understands and agrees that if
the dog purchased is a female, it will be a CO-OWNERSHIP between the Seller and Buyer
until the Buyer has fulfilled the following obligations:
1) It is understood
that the Buyer is under NO OBLIGATION to breed the dog. If
Buyer desires to breed the dog after she completes her AKC
championship, Buyer will allow Seller to purchase one (1) puppy from
the first litter whelped by the dog subject to this contract. That
puppy will be second choice. When Buyer has made first choice, Seller will then have next
choice puppy. Seller will make that choice when the puppies are between six (6) and seven
(7) weeks of age. The entire litter will be made available for the Seller’s viewing
and choice at that time (in person or by way of video tape).
2) In the event the female subject to this
contract has only one (1) live puppy from the first litter, that puppy will be Buyers.
From the second litter, Seller will again have second choice after Buyer has first choice.
3) At the time Seller makes their choice
of puppy and tenders the purchase price, Buyer agrees to immediately give to Seller the puppy’s AKC registration
papers signing full ownership to Seller. The Seller’s choice of puppy shall carry the
"Dreadnaught" prefix on it’s AKC registration paper. Seller reserves the
right to name said puppy.
4) The choice of stud dog is to be of
mutual consent between Seller and Buyer before the female dog subject to this contract is
bred. Seller shall not unreasonably withhold consent provided that Buyer’s choice of
stud dog is based upon sound breeding practices and principles. Buyer understands and
agrees that both Seller and Buyer have an obligation to improve the breed. Both Seller and
Buyer agree that they will attempt to carry forward the legacy of the ancestors of the
female dog subject to this contract. All costs of producing the litter(s) to include but
not limited to stud fee, veterinary care for the female and offspring shall be borne by
the Buyer.
5) Buyer will immediately notify Seller
when the litter is born including the number, sex and coloring of each puppy.
6) At such time as all of these
obligations are met, Seller will immediately sign ownership over to Buyer and no further
obligations pertaining to the CO-OWNERSHIP will be required.
M. Buyer agrees to not spay the female or
neuter the male without the express written consent of the Seller except where such
surgery is required as an emergency life saving procedure. If such an emergency takes
place, Buyer agrees to send to the Seller a detailed letter of explanation from the
Veterinarian who performed the surgery.
N. Buyer agrees that if either a male or
female is purchased, it may not be used for breeding until it has completed it’s AKC
conformation championship requirements. Buyer further agrees and understands that the male
or female may be bred only to other AKC registered Bullmastiffs who have also completed
their AKC conformation championship requirements.
O. Buyer agrees and understands that if
the dog subject to this contract develops severe crippling hip dysplasia in both hips by
the age of twelve (12) months, Seller will, provided a copy of such report is provided by
a licensed Veterinarian, replace said dog with an equal quality dog from the next
available litter, or offer a refund of the purchase price, option to be at the
Seller’s discretion.
P. Buyer agrees to supply to Seller
photographs of the dog taken at the ages of six (6) months, twelve (12) months, and
twenty-four (24) months.
Q. If any additional agreements or
requirements become necessary, they will be attached to this contract in the form of an
addendum. Should this provision be necessary, Seller and Buyer will initial this line.
